Terms of Service
These Terms of Service ("Terms") govern your use of the CELLDAM LAB online store at celldam.com (the "Store"), operated by KUBER SCIENCE CO., LTD. ("we", "us", "our"). By accessing the Store or placing an order, you agree to these Terms.
1. The Store
The Store sells cosmetic products directly to consumers. We reserve the right to change or discontinue any product, price or promotion at any time. Where a change affects an order you have already placed, we will notify you and you may cancel that order.
2. Eligibility
You must be able to form a legally binding contract in your jurisdiction to place an order. If you are a minor under the law applicable to you, you may use the Store only with the involvement of a parent or legal guardian.
3. Accounts
You are responsible for keeping your account and any sign-in code confidential and for all activity that takes place through your account. Notify us immediately if you believe your account has been used without your authorisation. You may close your account at any time by contacting us.
4. Product information
We take care to describe our products accurately. Colours shown on screen may differ from the actual product depending on your display. Ingredient lists, expiry information and usage precautions on the product packaging take precedence over the website where the two differ.
Statements about clinical or instrumental test results describe outcomes observed under the conditions of that specific test. Individual results vary. Our products are cosmetics; they are not medicines and are not intended to diagnose, treat, cure or prevent any disease.
5. Orders and contract formation
Placing an order is an offer to buy. A contract is formed only when we send you an order confirmation. We may decline an order if:
- the product is unavailable or incorrectly priced;
- we suspect fraudulent or unauthorised use of a payment method;
- we cannot ship to the address provided; or
- the order breaches these Terms or applicable law.
If we decline an order after payment, we refund the full amount.
6. Prices and payment
Prices are shown in the currency displayed at checkout and exclude shipping unless stated otherwise. We do not charge any additional fee for your choice of payment method. Payment is processed by our payment providers; we do not store your full card details.
7. Shipping, import duties and taxes
Delivery times, carriers and charges are set out in our Shipping Policy. For international orders, any customs duties, import taxes or handling fees charged by the destination country are the responsibility of the customer and are not included in the price paid at checkout. We cannot predict these charges. Refusal to pay them may result in the order being returned or destroyed by customs, and we cannot refund shipping in that case.
8. Returns and refunds
Your return and refund rights are set out in our Refund Policy, which forms part of these Terms. Where mandatory consumer law in your country of residence gives you greater rights, those rights apply.
9. Intellectual property
All content on the Store, including text, images, video, product photography and the marks CELLDAM LAB and BNEX, belongs to us or our licensors. You may not reproduce, distribute, publish or use any of it for commercial purposes without our prior written consent.
10. Acceptable use
You agree not to use the Store to: submit false information or impersonate another person; interfere with the operation or security of the Store; scrape, copy or resell our content; or infringe the rights of any third party.
11. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss arising from your use of the Store. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be limited.
12. Changes to these Terms
We may update these Terms. The version published on the Store at the time you place an order is the version that applies to that order. Material changes will be posted on this page with a revised date.
13. Governing law
These Terms are governed by the laws of the Republic of Korea, without prejudice to any mandatory consumer protection rights available to you in your country of residence.
